New Digital Securities as of February 1, 2021

The Swiss Parliament approved the new regulations for Distributed Ledger Technology (DLT Framework). The implemented elements will enable the introduction of uncertificated register securities (Registerwertrechte).

With this step, Switzerland becomes even more popular as a jurisdiction for enterprises in the fields of DLT like Blockchain.

The new regulations will increase legal certainty in civil law, insolvency law and anti-money laundering regulation and reduce the risk of abuse.

In February 2021 the first part of the new legislations with regards to Blockchain and Distributed Ledger Technology will enter into force. In order to create uncertificated register securities (Registerwertrechte) in a tokenized form, certain requirements according to the Swiss Code of Obligations must be fulfilled.
