HütteLAW goes China

HütteLAW hat sich mit der Partnerkanzlei „Horizons“ für die Tätigkeiten im Zusammenhang mit China verbunden. Die entsprechende Zulassung wurde am 18. April 2018 erteilt. Diesbezüglich gilt folgendes:

The Ministry of Commerce of the People’s Republic of China (“China”) has “acknowledged” the status of CCG as a “platform (“Platform”) of independent professional firms (“Firms”) that preferentially cooperate together to attract and develop foreign and Chinese investment in China; improving compliance and governance of investment of foreign and Chinese entities in China; attracting, counselling and protecting investment of Chinese companies abroad according to the procedure of the Belt and Road Initiative (“Activities”).” 

“The above cooperation mode shall be implemented through the Chinese professional legal entity Horizons (Shanghai) Corporate Advisory Co., Ltd. under (“Horizons”), the authorization number 91310000781537854P being the primary responsible person.”

The Firms of the Platform, selected and acknowledged, enjoy the “Rights” to:

 1)    Refer to the Platform with an exclusive name to be jointly defined through a signed resolution and communicated within three months from the date of acknowledgment of the Platform to the National Development and Reform Commission (“NDRC”) of China; NDRC has the right to require reformulating the Platform name.

 2)    Upon cooperation agreement with Horizons and on a non-exclusive base [rental/sub-rental agreement is not allowed], maintain adequate office space at 603B Lippo Plaza, 222 Huaihai Middle Road, Huangpu Central District, 200021 Shanghai, China (“Platform Premises”) for seminars, training, consultations, receiving and meeting clients related to the Activities of the Platform. Documents of each independent Firm cannot be stored in beyond 24 hours’ time and without the authorised partner of the said Firm at the premise.

 3)    Put up an appropriate panel list of preferred partners at the premises of Horizons showing Firm name, Country flag and name (principal office only), partner-in-charge name and surname.

 4)    Provide a press release about Platform’s Firms’ Activities according to the laws of the People’s Republic of China and only if jointly agreed upon. No autonomous press releases are permitted, and, in case, Horizons will be kept responsible under the Chinese Laws.

 5)    Exchange visiting lawyers and professionals.

 6)    Organise in China and abroad any type of seminars with the purpose to develop the Platform’s Clients.
